Important Information for West Orange Property Owners

The Township of West Orange has partnered with LEW Environmental to provide a comprehensive solution to ensure compliance with the new NJ law. If you received a postcard then records indicate one of your rental properties are impacted by this new law.

N.J.A.C. 5:28A Lead-Based Paint Inspections in Rental Dwelling Units

The new law states that certain rental units in West Orange built before 1978 are required to have a visual inspection to assess for lead hazards completed at the next tenant turnover, or by July 22, 2024.

Property owners with multiple unit buildings who have been registered with the DCA more than 10 years should speak with a member of LEW Environmental’s staff prior to scheduling your inspection to see if your units qualify for an exemption.

Depending on the results of the visual inspection, a lead safe certification will be issued which is proof of compliance with the regulation. The Lead-Safe Certification will be valid for a two-year period. If a tenant turnover occurs after the expiration of the certificate; another inspection is required. If there is no tenant turnover, then another inspection is required one year after the certificate expires (three years after the initial inspection).

Visual Inspections West Orange

Rental properties located in the Township of West Orange are required to undergo visual assessments for lead based paint hazards. So, the township has contracted with LEW Environmental Services to help get your rental properties compliant with the Lead Safe Certification Act.

Preparing For Your Visual Inspection

All of our inspectors are NJDCA certified and committed to cost-effective solutions for property owners. Our inspectors will come to your property and visually assess for signs of paint chipping and deterioration. But if no deteriorated conditions are found, then a Lead Safe certification will be issued. Lead Safe certificates are good for 3 years unless there is a tenant turnover after 2 years.

If deteriorated paint conditions are noted and the house is built pre-1978 then the presumption is that a lead hazard exists. Remediation may be required.

What Is Deteriorated Paint?

Per HUD guidelines, anything greater than a hairline crack or larger than a nail hole is considered deteriorated paint and will result in a lead safe certification NOT being issued.
